EOFVPN Terms of Use

1. INTRODUCTION

We are pleased that you have decided to use EOFVPN! These Terms of Use («Terms») govern your access to and use of EOFVPN’s websites, applications and services (collectively, the «Services»). By accessing our sites or using our Services, you agree to abide by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use EOFVPN.

We may update these Terms periodically. We will post the revised Terms on our website and update the «Last Updated» date at the bottom. Your continued use of EOFVPN after any changes to the Terms constitutes your agreement to the new Terms. If you do not agree to the changes, you must stop using our Services.

  • Violating intellectual property rights such as copyrights, trademarks or patents.
  • Engaging in harassment, threatening, stalking or inciting violence against others.
  • Transmitting spam, malware, viruses, or any other malicious code or content.
  • Attempting to gain unauthorized access to other EOFVPN users’ systems, networks or devices.
  • Interfering with or compromising the integrity or performance of EOFVPN services or servers.
  • Impersonating EOFVPN, its employees, or any other person or organization.
  • Promoting or participating in any fraudulent or deceptive schemes or practices.
  • Parsing, collecting data, or using automated tools to access or collect data from EOFVPN.
  • Reselling or distributing EOFVPN services without express written authorization.
  • Bypassing any security features, access restrictions or limitations on the use of EOFVPN.
  • Abusing our refund policy, payment systems, free trials or promotional offers.
  • Engaging in any other activity that violates the rights of EOFVPN or any third party.

EOFVPN reserves the right to investigate and take appropriate legal action against anyone who violates these terms of acceptable use, including terminating their account without notice and reporting their activities to the appropriate authorities.

EOFVPN is committed to providing a secure and lawful service for all users. You are strictly prohibited from using EOFVPN for any activity that violates applicable laws or infringes on the rights of others, including intellectual property rights.

You agree not to use EOFVPN to download, store, distribute or transmit any content that is itself illegal, infringes copyright or facilitates illegal activity («Prohibited Content»). EOFVPN does not actively monitor user traffic for Prohibited Content. However, we rely on our users to report any suspected violations of these Terms.

If you encounter any content or behavior on EOFVPN that you believe is illegal or does not comply with these Terms, please notify us by sending an email to abuse@eofvpn.cc. Your report must include:

  • A detailed explanation of why you believe the content violates the law or our Terms.
  • The exact URL or location of the Prohibited Content on the EOFVPN network.
  • If the content is infringing, please identify the copyrighted work(s).
  • Your full name, physical address, e-mail address and telephone number.
  • A statement that you have a good faith belief that the content is unauthorized.
  • A statement that your report is accurate and you have authority to act on behalf of the person concerned.
  • Your physical or electronic signature.

EOFVPN will review all properly filed reports and take appropriate action, which may include removing Prohibited Content, suspending or terminating the responsible user’s account, and/or reporting illegal activity to law enforcement authorities.

If EOFVPN receives a valid complaint about your use of our Services or determines that you have violated these Terms, we reserve the right to suspend or terminate your account and access to EOFVPN without notice.

The EOFVPN Services may be subject to export control and sanctions laws in various jurisdictions, including the United States and the European Union. You warrant that you are not located in an embargoed country or otherwise prohibited from receiving services under applicable export control laws. By using EOFVPN, you agree to comply with all applicable export and import regulations in your jurisdiction.

5. FAIR USE

All EOFVPN subscriptions are intended for reasonable personal use. Our Services are not intended for commercial use or for distribution to multiple users.

While we do not impose fixed limits on bandwidth or simultaneous connections, we reserve the right to monitor usage and take appropriate action against accounts that do not use our Services in good faith or negatively impact the performance of our network.

Examples of non-bona fide use may include, but are not limited to:

  • Using an excessive number of simultaneous connections from multiple devices or locations.
  • Constantly downloading the available Internet bandwidth or excessive uploading/downloading of data.
  • Giving access to your EOFVPN account to third parties or allowing access to unauthorized users.
  • Using EOFVPN on behalf of or for the benefit of a business, organization, or institution.
  • Using EOFVPN for commercial purposes.

Fair Use restrictions are necessary to prevent abuse and to ensure that all users can enjoy a high quality experience with EOFVPN. If we determine that your use is in violation of these fair use terms or is otherwise detrimental to our Services, we may:

  • Contact you to discuss your use and offer a more appropriate pricing plan.
  • Limit your connection speed or restrict available server locations.
  • Suspend your subscription or terminate your EOFVPN account without notice or refund.

By using EOFVPN, you acknowledge that our Services are not intended for activities that generate a sustained high volume of traffic or place excessive demands on our network infrastructure. We encourage you to use EOFVPN responsibly to protect your privacy.

6. SUBSCRIPTIONS AND PAYMENTS

EOFVPN offers various paid plans. The specific terms of each plan are described in our offer.

By purchasing an EOFVPN subscription, you agree to pay applicable fees and any taxes that may apply based on your location. Subscription prices are subject to change. We will notify you in advance of any price increase.

EOFVPN subscriptions are not automatically renewed at the end of each subscription period, you will need to contact our tech support to renew your subscription.

7. REFUND

Your satisfaction with EOFVPN is our top priority. If you are not completely satisfied with our paid Services, we offer a 7-day money back guarantee. You may request a refund within 7 days of your original purchase and we will refund you for that payment.

Before requesting a refund, we encourage you to contact our support team at user@eof.support or via telegram @eofsupport so that we can help resolve any issues you may have encountered.

You are entitled to two refunds. After the first refund, you may request a second refund only if at least 6 months have passed since the previous refund. If you purchase our Services again after receiving two refunds, you will not be eligible for additional refunds.

For monthly subscriptions, the 30-day refund window applies only to the original purchase. Once a monthly subscription is renewed, it is non-refundable under our money back guarantee.

In exceptional circumstances, we may consider a partial refund after the 30 day period if you can demonstrate that our Services were unavailable or unusable for a substantial part of your subscription period and you have made reasonable efforts to contact us about the matter. Partial refunds will be calculated in proportion to the number of days the Services were unavailable during your subscription period.

Refunds are not available for purchases made with prepaid cards or gift cards. For payments made in cryptocurrency, we will refund you the equivalent U.S. dollar amount in the same cryptocurrency at the exchange rate at the time of the refund.

If you purchased your EOFVPN subscription through third parties or app stores, refunds will be made in accordance with that vendor’s refund policy. Please contact the vendor directly to request a refund.

EOFVPN reserves the right to refuse refunds if we determine that you have violated our Terms of Use. We also reserve the right to verify your account usage information before processing a refund, which may result in a slight delay.

Any taxes or fees charged on your EOFVPN purchase are determined by your location and applicable tax laws. Refund amounts will be calculated exclusive of any taxes that EOFVPN is required to charge.

Deleting your account does not automatically issue a refund.

8. INTELLECTUAL PROPERTY

The EOFVPN website, applications, services and all related content, including software, logos, text, images and videos, are the exclusive property of EOFVPN and its licensors, protected by intellectual property laws. By using our Services, you do not acquire any ownership rights in EOFVPN.

These Terms grant you a limited, non-exclusive, non-transferable and revocable license to access and use EOFVPN for your personal, non-commercial purposes, subject to your compliance with these Terms. You may not reproduce, modify, distribute, sell or create derivative works of EOFVPN without our prior written consent.

If you provide EOFVPN with any feedback, suggestions or ideas related to our Services, you grant us a perpetual, worldwide, non-exclusive license to use and implement your suggestions without restriction or compensation to you.

9. DISCLAIMER AND LIMITATION OF LIABILITY

EOFVPN is provided on an «as is» and «as available» basis, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of our Services is at your own risk.

We do not warrant that EOFVPN will be uninterrupted, error-free, completely secure or free of viruses or other harmful components. EOFVPN is not responsible for any failure, delay or interruption in our Services, or for any data loss, corruption or disruption that may occur while using our Services.

To the fullest extent permitted by applicable law, in no event shall EOFVPN, its directors, employees, partners, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages or any loss of profits, data or opportunity arising out of or in connection with your use of EOFVPN, even if advised of the possibility of such damages.

Our total aggregate liability for any claims related to EOFVPN is limited to the subscription fees you paid to us during the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion of implied warranties or limitations of liability, so the above limitations may not apply to you.

10. INDEMNIFICATION

You agree to indemnify, defend and hold EOFVPN, its officers, directors, employees, agents and affiliates harmless from any claim, demand, loss, expense or liability, including reasonable attorneys’ fees, arising out of your use of our Services, violation of these Terms or infringement of third party rights.

EOFVPN reserves the right, at its own expense, to assume the exclusive control of the defense of any matter subject to indemnification by you. In such cases, you agree to cooperate with us in asserting any available defenses.

11. TERMINATION

EOFVPN reserves the right to suspend or terminate your access to our Services at any time without notice or liability for any reason, including if we reasonably believe that you have violated these Terms. We may also, in our sole discretion, terminate inactive accounts or unpaid accounts.

If EOFVPN terminates your account due to your violation of these Terms, you will not receive a refund for any prepaid subscription fees, and you may be prohibited from registering for our Services in the future.

You may cancel your subscription to EOFVPN at any time through our technical support. Cancellation will take effect at the end of the current payment cycle. Except for the 30-day money back guarantee on your original purchase, no refunds will be issued for partial payment periods.

12. SERVICE CHANGES

EOFVPN reserves the right to change our Services at any time without prior notice. We may need to add, change, or remove features, as well as temporarily or permanently suspend some of our Services. In the event of a significant change or termination of the Service, we will notify subscribers and provide a pro rata refund for any unused portion of their subscription.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or condition of these Terms does not constitute a waiver of such right or condition.

13. THE PREDOMINANT LANGUAGE

The original language of these Terms of Use is English. EOFVPN can provide translated versions of the Terms for the convenience of users. However, in case of any conflicts or discrepancies between the English version and the translated version, the English version takes precedence and is considered an authoritative and binding agreement between you and EOFVPN.
